Terms of service
General Terms and Conditions (GTC)
relating to the online services of B.R.-Vertrieb OHG, in particular the associated web shops at www.bonrullen-service.shop, www.bonrollenshop24.de and www.thermorollen.de, and the company website at www.brvertrieb.de.
§ 1 Scope
(1) Our GTC apply to all contracts that have been and will be concluded in connection with the aforementioned company website and the associated web shops (also “online shops”).
(2) Our offer is directed exclusively at entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), legal entities under public law or special funds under public law within the meaning of Section 310(1) BGB (hereinafter “Customer”). We shall only recognise any terms and conditions of the purchaser that conflict with or deviate from our General Terms and Conditions if we expressly agree to their validity in writing.
(3) The business relationship between the Customer and B.R.-Vertrieb OHG, Kleinheubach, Aschaffenburg Local Court, HRA 5592, shall be governed by these terms and conditions in the version valid at the time of the order. Any deviations from these terms and conditions require our written confirmation. We reserve the right to amend these terms and conditions at any time.
(4) It is the Customer’s responsibility to check for any changes to the terms and conditions with every purchase. These terms and conditions are governed by the laws of the Federal Republic of Germany and must be interpreted in accordance with those laws.
(5) If, during the ordering process, the customer states that they are acting as a business within the meaning of Section 14 of the German Civil Code (BGB) or on behalf of an institution, or if they give this impression through conclusive conduct (e.g. by entering company details at checkout), consumer protection law shall not apply. In this case, the customer is precluded from subsequently invoking consumer rights, in particular a statutory right of withdrawal, in accordance with the principles of good faith (Section 242 of the German Civil Code (BGB)).
(6) In all other respects, statutory provisions shall apply in addition, insofar as they are not directly amended or expressly excluded in these General Terms and Conditions.
§ 2 Offer, Conclusion of Contract and Contracting Parties
(1) Our offers are subject to change. The contract is only concluded upon acceptance of the order by us, B.R.-Vertrieb OHG. In the case of online orders, acceptance takes place by sending an order confirmation by email. For telephone orders, the order confirmation may be given over the telephone. For other forms of ordering, acceptance of the order may also take place through the execution of the delivery. The customer is responsible for providing a complete and correct billing and delivery address. Even if a SEPA Core Direct Debit fails or is revoked by the customer without giving reasons, the order remains valid and the customer is obliged to pay.
(2) The contract is concluded between us, B.R.-Vertrieb OHG, Kleinheubach, Aschaffenburg Local Court, HRA 5592, Managing Directors: Barbara and Thomas Rehm, and the customer.
(3) We offer our customers the option of placing orders using order forms or fax templates, which we provide for download in PDF format, for example. Even when using these forms, a contract is only concluded upon our acceptance of the order.
(4) A contract is not concluded if the customer cannot be contacted or verified upon order confirmation.
§ 3 Address details and order details – Special duty of care on the part of the customer
(1) The provision of correct address details is a fundamental prerequisite for the smooth processing of an order. The duty of care and verification lies solely with the customer. We are under no obligation whatsoever to carry out plausibility checks or to investigate any missing information. In the event of incomplete or obviously incorrect address details, we are entitled, at our sole discretion, to withdraw from the purchase contract.
(2) The customer’s special duties of care include:
Providing complete and correct address details, including legal form and email address;
Checking the address and order details provided against the order confirmation;
Immediate notification of any address errors, etc., during the ordering process;
Checking the invoice and delivery note details immediately upon receipt;
Reporting errors in invoice and delivery note details within three days of receipt of the goods.
(3) We expressly point out that we act in strict compliance with commercial and tax law requirements. Subsequent changes to address details are therefore time-consuming and only possible within strict limits. The considerable additional costs incurred by us in this regard are – at our request and provided the reason for the change is not attributable to us – to be reimbursed by the customer with a flat fee of €15 plus statutory VAT.
(4) Accordingly, the customer shall bear all third-party costs resulting from incorrect address details, e.g. additional delivery costs. In this case, we reserve the right to make any necessary second delivery conditional upon prior compensation for damages incurred by us or arising from the subsequent delivery.
(5) Requests for changes made more than 14 days after receipt of the goods are not possible, provided that the reason for the change is attributable to the customer.
§ 4 Prices and Invoices
(1) Our prices are quoted in euros and are exclusive of statutory value added tax (VAT). We reserve the right to correct errors, printing errors, price changes and technical modifications. The prices quoted at the time of ordering apply.
(2) Our invoices comply with all commercial and tax law requirements. Invoices are normally delivered with the goods in a dispatch envelope attached to the outside of the dispatch box. In addition, invoices may be sent simultaneously by email (PDF document) or by separate post.
(3) As stated in Section 2(3) of these Terms and Conditions, the customer has the option of placing orders using order forms or fax templates. In the event of differing price quotations, the offer price displayed in the shopping basket system of our online shops at the time of ordering shall always apply.
(4) If an order is placed using forms without price details, the shopping basket prices displayed in our online shops at the time of ordering shall always apply.
(5) For all orders placed outside the online shop’s shopping basket systems – i.e. via fax, email, WhatsApp, SMS or post – it is the customer’s particular responsibility, in conjunction with paragraph 1, to inform themselves in advance of the offer price applicable at the time of ordering.
§ 5 Delivery, delivery time and tracking
(1) Standardised shipping is carried out within the “GoGreen Plus” programme using the logistics company DHL. For larger order quantities or to optimise customer service, we reserve the right to commission another service provider – e.g. a freight forwarder – of our choice to deliver the goods. We also reserve the right to use palletised and partial deliveries for larger shipping orders.
(2) Delivery usually takes place within one to two working days from the time the order is received. For custom-made items, the date of completion applies. If items are not in sufficient stock, delivery delays may occur.
(3) Should items be temporarily or permanently unavailable, we will inform the customer immediately. In this case, we reserve the right to withdraw from the contract and not to deliver the ordered goods if they are unavailable. Should the purchase price have already been paid, it will be refunded immediately.
(4) By giving your consent during the ordering process, you agree to your email address being passed on to the delivery service provider DHL. Tracking information regarding your delivery (parcel tracking) will then be automatically sent to you during the order processing.
§ 6 Delivery charges (domestic)
Within the Federal Republic of Germany, we generally deliver goods free of charge.
§ 7 Shipping costs (international)
(1) The shipping costs for an order to Austria are a flat rate of 11.90 euros per 31 kg of transport weight or part thereof.
(2) The shipping costs for an order to
Belgium
the Netherlands
Luxembourg
are a flat rate of €19.90 per 31 kg or part thereof of transport weight.
(3) The transport weight is the sum of all individual weights per box as specified in the relevant product descriptions. The automatic calculation of shipping costs in the online shops applies up to a total weight of 620 kg. Shipping costs for transport weights exceeding this limit must be enquired about by telephone prior to placing an order.
(4) Delivery to other countries (worldwide) is generally possible, but will only take place following prior agreement on the amount and allocation of shipping costs and any additional costs, such as customs duties or special shipping methods. The customer must comply with national import regulations for the respective products. We accept no responsibility for the compliance of our products with national guidelines and regulations outside the European Union (EU).
§ 8 Payment
(1) Our invoices are denominated in euros. We offer the following payment methods:
Cash payment upon collection at our premises
Payment on account
Payment in advance (discount: 2% of the total price)
Payment by SEPA Core Direct Debit (discount: 2% of the total price)
Payment via PayPal to: mail@brvertrieb.de
Payment by credit card
Payment via Google Pay
Payment via Apple Pay
(2) The customer may select a preferred payment method when placing an order. We reserve the right to restrict the choice of payment methods in individual cases, for example if creditworthiness is not established, for higher order values, or in the event of outstanding debts from previous deliveries. The exact payment date depends on the chosen payment method. For all payment methods where we debit the invoice amount, this will take place no earlier than the day of the first delivery attempt.
(3) If we already hold a SEPA Core Direct Debit mandate from the customer, but the customer selects a different payment method when placing an order, we are entitled to use the SEPA mandate instead.
(4) In the case of bank transfer (prepayment), the customer shall pay the invoice amount into one of our accounts prior to delivery of the goods:

§ 9 Warranty
(1) Our product photographs show the product described at the time the photograph was taken. The product delivered may differ from the images, for example in the brightness of the paper colour, without this affecting its fitness for purpose. Changes may occur, for example, due to the implementation of legal requirements, the increased use of recycled materials, and similar factors.
(2) We guarantee that the goods are free from manufacturing defects and material faults, although production-related deviations of up to five per cent (%) of the diameter or length of the paper rolls are unavoidable and must therefore be tolerated.
(3) Notwithstanding Section 438(1)(3) of the German Civil Code (BGB), our general warranty period for claims arising from material defects and defects of title is twelve months from delivery of the goods.
(4) Obvious defects must be reported to us in writing no later than two weeks after delivery. Obvious defects include, in particular, any discrepancies between the order quantity and the delivery quantity, as well as obvious discrepancies or damage to the goods identified by random sampling of the entire delivery. Later complaints regarding obvious defects are not permitted.
(5) In the event of a warranty claim, we shall be entitled, at our discretion, to remedy the defect by way of subsequent performance in accordance with Section 439 of the German Civil Code (BGB) (e.g. replacement delivery or refund of the purchase price). If the rectification of the defect fails, you may withdraw from the contract (see Sections 440, 323 and 326(5) of the German Civil Code (BGB)) or demand a reduction in the purchase price (see Section 441 of the German Civil Code (BGB)). Any further claims by the customer, in particular claims for damages, are excluded, unless the damage was caused by us or our vicarious agents through wilful misconduct or gross negligence.
(6) Returns shall be made either by us or by the customer themselves. In the event of a return by us, we or a transport company commissioned by us shall collect the goods from the customer. The customer must ensure that the goods intended for return are made available in a suitable and shippable condition. Returns by the customer shall be made independently, e.g. by post. Goods returned to us carriage forward will not be accepted. Any returns for which we have not received prior written notification from the customer of their intention to return the goods, or where we have not been given sufficient opportunity to arrange collection, shall release us from any liability to compensate for the costs associated with the return. These costs shall then be borne solely and in full by the customer.
§ 10 Liability
Liability is limited to a maximum of the order value. We are not liable if the recipient cannot be reached at the specified delivery address on the day of delivery.
§ 11 Retention of title
The delivered goods remain our property until all claims have been paid in full.
§ 12 Voluntary right of return
(1) The customer has no statutory right of withdrawal. However, the seller grants business customers a voluntary right of return within 14 days of receipt of the goods. This right of return applies only to unopened, undamaged original packaging (complete packaging units).
(2) The request to return goods must be made in writing (e.g. by email, fax or letter) to:
B.R.-Vertrieb OHG
Bahnhofstraße 16
D – 63924 Kleinheubach
mail@brvertrieb.de
Fax: +49 (0) 9371 / 948 97 22
Consequences of Return
(3) In the event of a valid return, the services received by both parties must be returned. The customer bears the costs and the transport risk of the return shipment. Upon receipt and successful inspection of the undamaged and unopened goods at the seller’s warehouse, the purchase price (excluding the original delivery costs) will be refunded. If the goods delivered do not correspond to the goods ordered (incorrect delivery), the return is free of charge для the customer.
(4) The mere refusal to accept the goods does not constitute a valid exercise of the voluntary right of return. If a refusal to accept the goods occurs for a reason for which the seller is not responsible, the customer shall bear all return costs incurred as a result, as well as the costs of any subsequent deliveries.
§ 13 Return of items no longer required by the customer
(1) In principle, the above provisions regarding the voluntary right of return under § 12 apply. The seller is under no obligation to accept returns of goods beyond the time limits specified therein. Any subsequent return made as a gesture of goodwill does not give rise to any legal obligation and will only be considered for complete, undamaged and unopened packaging units.
(2) The following categories of items are generally excluded from return as a gesture of goodwill after the expiry of the 14-day return period:
Ink ribbons and ink ribbon cartridges;
Paper rolls whose imprints no longer comply with technical or legal standards at the time of the return request;
All items whose contents no longer comply with technical or legal standards at the time of the return request;
All items purchased more than one year ago;
Custom-made and bespoke items.
(3) It is therefore the customer’s responsibility to determine the order quantity of each item based on their actual requirements.
§ 14 Data Protection
All personal data provided to us will be treated confidentially and in accordance with the provisions of the Federal Data Protection Act and the Teleservices Data Protection Act. Where necessary, this data may be passed on to third parties directly involved in the order processing and subject to the same data protection provisions. For further information, please refer to our privacy policy.
§ 15 Packaging subject to the packaging participation scheme
In accordance with the Packaging Act, we are registered with the Central Packaging Register (ZSVR). To fulfil the participation obligations directly incumbent upon us, we participate in the exemption scheme of Landbell AG, Rheinstraße 4L, D-55116 Mainz.

It is certainly understandable that we will pursue infringements and any resulting damages to the full extent of the applicable legislation and case law.

Please notify us immediately in writing of the latter; we will then confirm our consent. Also excluded are all third-party components and services whose intellectual property rights and copyrights are held by the respective company, such as ShopFactory or Google.
(3) If you are interested in using components of our websites, please contact Mr Udo Rehm by email at post[at]rehm-admin.de.
§ 17 Severability clause
Should individual provisions of the contract, including these terms, be wholly or partially invalid, or should the contract contain a loophole, the validity of the remaining provisions or parts thereof shall remain unaffected. The invalid or missing provisions shall be replaced by the relevant statutory provisions.
§ 18 Final Provisions (Applicable Law, Place of Performance and Jurisdiction)
(1) Contracts concluded between us and the customer shall be governed exclusively by the laws of the Federal Republic of Germany. The UN Convention on Contracts for the International Sale of Goods (CISG) shall expressly not apply.
(2) The place of performance and venue for all disputes arising from the contractual relationship, as well as all legal grounds arising therefrom, shall be – where possible – 63924 Kleinheubach, B.R.-Vertrieb OHG.
